By sending your electronic device (phone, tablet, or computer) for repair (the "Device"), you agree to the following Terms and Conditions. These terms apply to all mail-in repair services provided by AVS Electronic Serives DBA: Mobitechxpress (the "Company").
a. Requesting Repair Services: To initiate the repair process, you must submit a repair request via our online portal or contact our customer service team. The Company will provide instructions for securely packaging and mailing your Device to our repair facility.
b. Assessment: Once we receive your Device, we will conduct an initial assessment. If additional repairs are needed beyond what was originally requested, we will contact you for approval before proceeding.
c. Repair Timeline: Repair timelines are estimates. While we strive to complete repairs within 5 business days from receipt, unforeseen issues or parts availability may extend this time frame.
a. Packaging Responsibility: You are responsible for securely packaging your Device for shipment. The Company is not liable for damage that occurs during shipping. We recommend using a sturdy box with sufficient padding and tracking services.
b. Shipping Costs: You are responsible for the cost of shipping the Device to us. If the repair is covered under warranty or the terms of an agreement, shipping fees may be waived.
c. Return Shipping: Upon completion of the repair, the Company will return your Device using USPS service at no additional charge unless specified otherwise.
a. Warranty on Repairs: Repairs performed by the Company come with a warranty period of 30 days from the date of completion. This warranty covers only the specific repair performed and does not apply to damages or issues unrelated to the original repair.
b. Non-Warranty Repairs: If the repair is not covered by warranty, or if there is a need for further repairs after the warranty expires, the Company will notify you and provide a cost estimate for approval.
c. Exclusions: The following are not covered under the repair warranty:
- Accidental damage
- Water damage
- Unauthorized repairs or modifications
- Software issues or data recovery (unless specified)
- Damage caused by misuse or neglect
a. Data Responsibility: You are solely responsible for backing up all data on your Device before sending it to the Company. The Company is not responsible for data loss or corruption that may occur during the repair process.
b. Privacy and Security: The Company is committed to protecting your privacy. Any personal information or data on the Device will be handled in accordance with our Privacy Policy.
Limitation of Liability: To the extent permitted by law, the Company’s liability for any damage to your Device is limited to the cost of the repair service and is not responsible for loss of data, personal property, or other incidental or consequential damages.
b. Risk of Loss: You bear the risk of loss until the Device is received by the Company. The Company will take reasonable care in handling and storing your Device.
a. Cancellation of Repair Services: You may cancel your repair request at any time before the repair is completed. If you cancel after shipment, you may be responsible for return shipping costs. If we’ve already performed work on your Device, charges for that work will apply.
b. Refund Policy: Refunds are only provided if the repair service is canceled before the repair process begins or if the Device is deemed irreparable and no replacement parts are available.
By shipping your Device to the Company for repair, you acknowledge and agree to these Terms and Conditions. The Company reserves the right to modify these terms at any time without prior notice. All changes will be posted on our website.
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of laws principles. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Harris County, Houston, Texas.
