TO THE FULLEST EXTENT PERMITTED BY LAW, YOU EXPRESSLY WAIVE YOUR RIGHT TO A JURY TRIAL AND YOUR RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING. IN NO EVENT SHALL MOBITECHXPRESS’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS, DISPUTES, OR CAUSES OF ACTION ARISING OUT OF OR RELATING TO THIS AGREEMENT, THE SITE, OR THE SERVICES EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO MOBITECHXPRESS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR ONE HUNDRED U.S. DOLLARS ($100.00 USD), WHICHEVER IS GREATER.

FORCE MAJEURE: Neither AVS Electronic Services, LLC (DBA: Mobitechxpress) nor its affiliates shall be held liable or responsible, nor be deemed to have defaulted under or breached these Terms and Conditions, for any delay or failure in performance of its obligations hereunder resulting from acts, events, or causes beyond its reasonable control. Such causes include, but are not limited to: acts of God, natural disasters, severe weather, fires, floods, earthquakes, epidemics, pandemics, public health emergencies, acts of war, terrorism, civil unrest, riots, sabotage, labor disputes, strikes, supply chain disruptions, shortage of critical electronic parts or materials, power grid or internet outages, or actions, orders, or restrictions imposed by any governmental authority.

REPAIR AUTHORIZATION AND RELEASE OF LIABILITY: By delivering your electronic device to AVS Electronic Services, LLC (DBA: Mobitechxpress) or authorizing any service, diagnostic, or repair work, you expressly authorize Mobitechxpress technicians to perform repair services on your device. You acknowledge and agree that Mobitechxpress operates as an independent service provider and is not an authorized service center for any original equipment manufacturer (OEM), unless expressly stated otherwise in writing. You acknowledge that repairs performed by third parties may void manufacturer warranties or alter water/dust resistance ratings. To the maximum extent permitted by applicable law, you agree to release, defend, indemnify, and hold harmless Mobitechxpress, its officers, employees, and technicians from any and all claims, liabilities, losses, or damages to your device or data arising out of or in connection with the performance of repair services, except solely in cases of proven gross negligence or willful misconduct by Mobitechxpress.

PASSCODE AND DEVICE ACCESS REQUIREMENTS: To perform essential quality assurance testing—including post-repair diagnostics of touch responsiveness, display matrix integrity, camera functionality, audio output, proximity sensors, and network connectivity—Mobitechxpress requires device passcode access. You agree to provide correct passcodes or temporary credentials prior to service. If you choose not to provide access credentials, Mobitechxpress will complete the requested hardware repair but disclaims all liability for unverified secondary feature defects or post-repair functionality issues that could not be verified prior to device pickup.

UNCLAIMED PROPERTY, DEVICE ABANDONMENT, AND DATA LOSS: Mobitechxpress will notify you via the contact information provided on your service ticket (phone, SMS, or email) when your device repair is completed or diagnosed. It is your sole responsibility to ensure your contact details remain accurate. If you fail to pick up your device, pay outstanding balances, or arrange for return delivery within thirty (30) days following initial notification, a daily storage fee may accrue. If a device remains unclaimed for sixty (60) calendar days after service completion notification (or such longer period as required by applicable Texas law), the device shall be deemed strictly abandoned (“Abandoned Device”). Upon abandonment, you expressly forfeit all title, ownership, property rights, and stored data in the device to AVS Electronic Services, LLC (DBA: Mobitechxpress). You acknowledge and agree that Mobitechxpress accepts no liability for permanent data loss, data destruction, or unauthorized third-party access resulting from the sanitization, factory resetting, recycling, component harvesting, or resale of an Abandoned Device under Texas business and personal property statutes.

TERMINATION AND SURVIVAL OF TERMS: These Terms and Conditions remain effective until terminated by either you or AVS Electronic Services, LLC (DBA: Mobitechxpress). You may terminate these Terms at any time by formally notifying Mobitechxpress in writing and immediately discontinuing all further access to and use of the Site and Services. Mobitechxpress reserves the right, at its sole discretion, to terminate or suspend your access to the Site or Services, in whole or in part, at any time without prior notice or liability, if you fail to comply with any provision of these Terms or engage in conduct detrimental to the Site or Services. Termination of this agreement shall not relieve or affect any accrued rights, payment obligations, or liabilities incurred prior to the effective date of termination. Provisions of these Terms that by their nature should survive termination shall survive, including without limitation: ownership provisions, warranty disclaimers, indemnity, limitations of liability, mandatory arbitration, and governing law clauses.

PRICING, ESTIMATES, AND SHIPPING FEES: Prices for all repair services, diagnostic procedures, and replacement parts are subject to change without prior notice. Any price quotes, estimates, or diagnostic assessments provided by AVS Electronic Services, LLC (DBA: Mobitechxpress) are non-binding informational estimates only and may vary based on market availability, localized hardware requirements, hidden physical or liquid device damage, or specific service complexities. Mobitechxpress does not guarantee fixed pricing prior to final service intake and reserves the right to adjust pricing as necessary. Customers are fully responsible for all shipping, handling, freight, insurance, and third-party courier fees associated with delivering or returning devices for service.

REPLACEMENT PARTS AND COMPONENT DISCLOSURE: Service and repair pricing may vary depending on the specific replacement parts selected or required for your device. By default, AVS Electronic Services, LLC (DBA: Mobitechxpress) utilizes high-quality aftermarket parts engineered to meet or exceed original performance and reliability standards at a cost-effective price. Original Equipment Manufacturer (OEM) or remanufactured parts may be requested or utilized where available; however, OEM components are subject to parts availability and typically incur higher parts costs and extended processing times (typically requiring two (2) to five (5) business days for transit and delivery prior to repair completion).

BEST PRICE GUARANTEE POLICY AND ELIGIBILITY: AVS Electronic Services, LLC (DBA: Mobitechxpress) offers a 5% Best Price Guarantee on qualifying items. If you locate an eligible lower price for an identical item, Mobitechxpress will match the verified price and apply an additional 5% discount on the difference. To qualify for price matching, all of the following conditions must be met:

• Authorized U.S. Retailers: The advertised price must originate from an authorized U.S. domestic retailer (in-store or direct online storefront).
• Total Delivered Cost: Price comparisons are evaluated on the total final price, including applicable sales tax, shipping, handling, and delivery fees.

REPLACED PARTS DISPOSITION AND PROPERTY TRANSFER: Unless explicitly prohibited by applicable Texas law or agreed upon in writing prior to the commencement of service, all damaged, defective, or replaced parts, components, hardware, and sub-assemblies removed from your device during the repair process shall immediately become the exclusive property of AVS Electronic Services, LLC (DBA: Mobitechxpress). Mobitechxpress reserves the unencumbered right to recycle, sanitize, harvest for micro-components, refurbish, or dispose of such replaced parts in accordance with environmental regulations and state statutes, with zero obligation or liability to account to you for their value or disposition.

NON-OEM COMPONENT NOTIFICATIONS AND DISPLAY DISCLAIMER: On iPhone 11 and newer models, Apple iOS displays an “Important Display Message” or “Important Battery Message” if the operating system detects a non-OEM or non-serialized component replacement. These system alerts appear on your lock screen for up to four (4) days and within the main Settings menu for approximately fifteen (15) days. You acknowledge and agree that these notification pop-ups are a standard feature of iOS, are intended solely to indicate part history, and do not impair or restrict your ability to use the device.

REPAIR ACKNOWLEDGMENT, FUNCTIONALITY ASSUMPTION, AND RESTOCKING TERMS: By authorizing AVS Electronic Services, LLC (DBA: Mobitechxpress) to perform a screen, display assembly, or battery replacement on an iPhone 11 or newer model, you acknowledge and agree to the following terms:

• Performance & Display Variation: You assume full responsibility for potential subtle differences in color temperature, brightness, resolution, touch sensitivity, refresh rate, or battery health percentage reporting when choosing non-OEM or refurbished replacement components compared to original factory parts.
• True Tone & Micro-Code Features: Certain proprietary feature sets (such as True Tone or automatic brightness calibration) may be altered or disabled unless specialized micro-soldering or EEPROM logic transfer services are specifically requested and authorized in writing prior to repair.
• Limitation of Post-Repair Liability: You acknowledge that repairs are undertaken at your direction. To the maximum extent permitted by law, Mobitechxpress shall not be liable for non-repair-related pre-existing conditions, board-level failures, or subsequent software lockouts resulting from Apple operating system updates.

MANUFACTURER WARRANTY DISCLAIMER AND MOBITECHXPRESS LIMITED WARRANTY: You expressly acknowledge and agree that repairs, alterations, or diagnostic procedures performed by AVS Electronic Services, LLC (DBA: Mobitechxpress)—an independent, third-party service provider—may void original equipment manufacturer (OEM) warranties, extended service plans, or water/dust resistance ratings, particularly on Apple iOS devices and other modern consumer electronics. Mobitechxpress assumes no responsibility or liability for any voided manufacturer warranties or cancelled service agreements resulting from repairs performed at your request. In lieu of OEM warranties, Mobitechxpress provides its own limited warranty covering specific replacement parts and repair labor, subject to our explicit warranty terms, exclusions, and limitations.

1. Part Grade Classification: AVS Electronic Services, LLC (DBA: Mobitechxpress) uses replacement parts categorized under the following grades:
   • OEM (Original Equipment Manufacturer): Genuine parts manufactured by or directly for the original device manufacturer. (Available upon request, subject to market availability and higher cost).
   • Refurbished: Original OEM core components that have been reconditioned or restored to full functionality.
   • Premium Aftermarket / Soft OLED: High-grade third-party replacement parts designed to closely match OEM performance, color accuracy, and durability.
   • Standard Aftermarket / Hard OLED / Incell LCD: Cost-effective third-party replacement parts that meet standard functional specifications.
2. Default Parts & System Notifications: Unless an OEM part is specifically selected and authorized by the customer on the intake ticket, Mobitechxpress will default to using high-quality aftermarket or refurbished parts. I acknowledge that third-party or non-OEM replacement parts (specifically on modern iOS and Android devices) may trigger operating system notifications (e.g., “Important Display/Battery Message”) or result in minor software limitations (e.g., loss of True Tone or Battery Health percentage readouts). These warnings do not affect the physical functionality of the part and do not constitute a defect.

MOBITECHXPRESS LIMITED REPAIR AND PARTS WARRANTY: AVS Electronic Services, LLC (DBA: Mobitechxpress) provides a thirty (30) day limited warranty on replacement parts and repair labor, effective from the date of completed service or device pickup. If a replacement part installed by Mobitechxpress fails or proves defective during this 30-day warranty period, Mobitechxpress will, at its sole discretion, repair or replace the defective component at no additional charge for parts or labor.

WARRANTY EXCLUSIONS AND VOIDABILITY: This limited warranty applies strictly to the specific parts replaced and services rendered during the original repair ticket. The warranty shall be rendered completely null and void under any of the following conditions:

• Physical or Accidental Damage: Subsequent drops, impacts, pressure marks, cracked screens, bent frames, or physical mishandling occurring after repair completion.
• Liquid & Environmental Exposure: Any evidence of liquid ingress, moisture exposure, corrosion, heat damage, or environmental contamination.
• Misuse & Modification: Misuse, improper charging/voltage use, unauthorized software modifications (e.g., jailbreaking or rooting), or hardware alterations.
• Third-Party Tampering: Any evidence that the device or installed parts were opened, serviced, inspected, or tampered with by any party other than Mobitechxpress after service completion.

MODIFICATIONS AND UPDATES TO TERMS OF SERVICE: AVS Electronic Services, LLC (DBA: Mobitechxpress) reserves the right, at its sole discretion, to modify, update, amend, add, or remove portions of these Terms and Conditions at any time without prior individual notice. Any modifications or changes will become effective immediately upon posting to this Site with a revised “Effective Date” indicated at the top or bottom of this document. Your continued access to or use of the Site, diagnostic services, or repair services following the posting of any revised Terms constitutes your express acknowledgment, acceptance, and agreement to be bound by such modifications and updates. We encourage you to review these Terms periodically to remain informed of any revisions.
