These Terms and Conditions apply to all users of the Service, including visitors, members, and users who contribute content, information, and other materials or services on the Site. If you do not agree unconditionally to all terms and conditions of the Terms and Conditions, you may not use the Site or Services. Mobitechxpress’s acceptance depends on your assent to all terms and conditions of this agreement. Your continued use of or access to the Site and/or Services constitutes acceptance of these Terms and Conditions.

These Terms and Conditions govern your use of the mobitechxpress.com website (the “Site”) and the services available on or through the Site (the “Service”). Mobitechxpress owns and operates the Service. The Service is provided subject to acceptance of and compliance with all terms, conditions, policies, and procedures outlined herein, as well as any operating rules or guidelines published on the Site by Mobitechxpress.

The Service is available only to individuals who are at least 18 years old, emancipated minors, or those with legal parental or guardian consent, and who are fully competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms of Use, and to abide by and comply with these Terms of Use. Mobitechxpress may refuse service at its sole discretion and may change eligibility criteria at any time.

Mobitechxpress reserves the right to modify or replace any part of these Terms of Use at its discretion. It is your responsibility to review these Terms periodically for updates. Your continued use of the Service after posting or notification of any changes constitutes acceptance of those changes.

You retain ownership of content you submit to the Site, such as reviews or comments. However, by submitting content, you grant Mobitechxpress a non-exclusive, worldwide, royalty-free license to use, modify, publish, or distribute that content in connection with the operation of the Site or Services. You further agree that your content will not infringe upon third-party rights and complies with all applicable laws.

You are responsible for maintaining the confidentiality of your account and password, and for restricting access to your computer or device. You agree to accept responsibility for all activities under your account, whether or not authorized by you.

You agree to indemnify, defend, and hold harmless Mobitechxpress, its officers, employees, agents, and affiliates from any and all claims, liabilities, damages, losses, and expenses, including legal fees, arising from your use of the Site or Services, violation of these Terms of Use, or infringement of intellectual property or other rights of any person or entity.

The Site may contain links to third-party websites or content not owned or controlled by Mobitechxpress. Mobitechxpress does not endorse or assume responsibility for third-party websites or content. By using the Site, you acknowledge that Mobitechxpress is not liable for damages or losses caused by third-party websites.

This agreement includes a mandatory arbitration clause, requiring any dispute arising from the use of the Services to be resolved by arbitration before a single arbitrator. Additionally, it waives the right to a jury trial or participation in any class action. If you do not agree to these terms, you may not use the Services.

To the maximum extent permitted by law, Mobitechxpress, its affiliates, and employees will not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the use of the Site, Services, or any content, whether or not Mobitechxpress was aware or should have been aware of the possibility of such damages. In no event will Mobitechxpress’s total liability to you exceed the amount you paid, if any, for using the Service.

Mobitechxpress is not liable for any delay or failure to perform under these Terms of Service due to causes beyond its reasonable control, including but not limited to acts of God, war, terrorism, labor disputes, government actions, or natural disasters.

By accepting the Service, you authorize Mobitechxpress technicians to perform repair work on your electronic device. While Mobitechxpress technicians are trained, Mobitechxpress is not an authorized service provider. You agree to release, indemnify, and hold Mobitechxpress harmless from claims or damages arising from the repair work, except in cases of gross negligence by Mobitechxpress agents or technicians.

Mobitechxpress will contact you when your device is ready for pickup. If you fail to pick up your device or arrange for its return within 60 days (or a longer period required by Texas law) after the completion of services, Mobitechxpress will consider your device abandoned. The device will become the property of Mobitechxpress, which may dispose of or sell the device to recoup administrative and repair costs in accordance with applicable law.

These Terms are effective until terminated by either you or Mobitechxpress. You may terminate the Terms by notifying Mobitechxpress that you no longer wish to use the Services or by ceasing use of the Site. Mobitechxpress may terminate this agreement at any time, with or without notice, if you fail to comply with any term of these Terms. Termination does not affect obligations or liabilities incurred before termination.

Prices for services may change. Quotes or estimates may vary depending on factors such as location or service type. Mobitechxpress does not guarantee any price and may adjust pricing as necessary. Customers may be responsible for shipping, handling, and courier fees related to services.

Repair pricing may vary based on the parts used. Mobitechxpress typically uses aftermarket parts that meet or exceed the quality of original components but are more affordable. Remanufactured or OEM (Original Equipment Manufacturer) parts may be available upon request, but they will be more expensive and subject to availability. OEM parts may require 2 to 5 business days for delivery.

Mobitechxpress offers a 5% Best Price Guarantee. If you find a lower price for the same product, we will beat it by 5%. This guarantee applies to:

• Advertised prices from U.S. domestic retailers (in-store and online)
• Final price, including taxes and shipping fees
• Exact-match, new, factory-sealed products with a manufacturer’s warranty
• Stocked items available for immediate shipment or installation

Exclusions:

• Overseas retailers or websites
• Liquidation sales, misprints, commercial quantities, coupons, discount codes, or cash-back offers
• Marketplaces like eBay, Facebook, and Amazon
• Grey-market imports without a U.S. manufacturer’s warranty

Mobitechxpress trademarks and service marks, as well as any logos or brand features owned by Mobitechxpress, are proprietary and protected by law. Unauthorized reproduction, distribution, or use is prohibited unless expressly authorized by Mobitechxpress.

Mobitechxpress is an independent service provider, not affiliated with Apple Inc., Samsung, or Google. Any mention of iPhone, iPod, iPad, or similar trademarks is for identification purposes only. Mobitechxpress is not authorized to perform repairs on behalf of these companies.

Unless required by Texas law, all replaced parts, components, or devices become the property of Mobitechxpress. You waive all rights to the replaced parts or devices, and Mobitechxpress may dispose of or use them as it sees fit, subject to applicable laws.

On iPhone 11 or newer device’s, an ‘Important Display Message’ will appear if the phone detects a non-genuine replacement screen or battery. This message explains potential impacts on functionality and indicates that future servicing may be affected. The message appears on the lock screen for four days and in Settings for 15 days. These notifications do not affect the ability to use the device.

By authorizing Mobitechxpress to replace your iPhone 11 or newer device’s screen or battery, you assume responsibility for any differences in color, resolution, or functionality from the OEM screen or battery. The replacement is at your own risk. Mobitechxpress is not responsible for any malfunction of your device after the replacement. If you request the reinstallation of the OEM part, you agree to a 25% restocking fee of the repair cost.

Repairs by Mobitechxpress may void your manufacturer’s warranty, particularly on iOS devices. Mobitechxpress does not assume liability for voided manufacturer warranties but may offer its own warranty for parts and services.

Mobitechxpress provides a 30-day limited warranty on parts and services performed. If a part is defective, Mobitechxpress will repair or replace it at no additional charge. This warranty does not cover damage from mishandling, water exposure, misuse, unauthorized repairs, or modifications. The warranty is void if there is evidence of tampering or damage due to misuse or environmental factors.

Mobitechxpress reserves the right to update this Terms of Service policy at any time. Any changes will be posted on the website with an updated “Effective Date.” We encourage you to review this policy periodically.
